Reasons the DEA May Suspend or Revoke a Registration

  • The registrant provided false information in a DEA registration application.
  • The registrant is convicted of a felony offense involving controlled substances, such as unlawful prescribing, unlawful dispensing, or conspiracy to possess, dispense, or distribute a controlled substance.
  • A state licensing board or authority has suspended or revoked a provider's medical license.
  • A provider has been excluded from participation in Medicare, Medicaid, or another insurance program.
  • DEA personnel believe that allowing the provider to maintain registration would not be in the public interest due to the provider's ineffective controls against drug diversion, noncompliance with drug laws, history of controlled substance distribution, or other applicable factors that affect public health and safety.

When the DEA plans to suspend or revoke a registration, an Order to Show Cause will be issued and served to the registrant. In cases where DEA personnel believe that there is an imminent danger to public safety, an immediate suspension order may also be issued that will result in the loss of DEA registration until further notice. A registrant must take action to request an administrative hearing or provide a written statement within 30 days after being served with an Order to Show Cause, and failure to do so will likely lead to their registration being suspended or revoked as requested by the DEA.

In some situations, the DEA will attempt to avoid the legal process of making a case against a provider and demonstrating the need for a suspension or revocation by requesting that the provider voluntarily surrender their DEA registration. However, if a registrant agrees to do so, they will waive their right to an administrative hearing, and they may be unable to reapply for registration in the future.
