Illinois Dentist Defense Attorney

Illinois Dentist License Defense Lawyer

Skilled Board of Dentistry Defense Lawyer in DuPage County, Cook County, Illinois, and Throughout the U.S.

There are thousands of dental professionals practicing in the state of Illinois. These professionals are licensed and regulated by the Illinois Board of Dentistry, a part of the Illinois Department of Financial and Professional Regulation (IDFPR). Dentists who are having difficulty obtaining a license or are in danger of having their license suspended or revoked should seek skilled legal counsel as soon as possible to preserve and protect their careers.

At The Law Offices of Joseph J. Bogdan, Inc., we have over 16 years of experience helping dentists with licensing issues before the Illinois Dental Board, and we provide legal help with a wide variety of other issues that affect licensed professionals. Joseph Bogdan is both an attorney and a registered pharmacist with extensive medical and legal backgrounds. Attorney Bogdan is a board member of the Illinois Pharmacist Association, as well as a Pharmacy Law teacher at three Chicago-area Colleges of Pharmacy. Prior to entering private practice, Attorney Bogdan was a prosecutor for the IDFPR. He knows the ins and outs of this agency, which cases are typically investigated or prosecuted, and what is necessary to secure positive outcomes for health care professionals who are facing disciplinary action.

The Illinois Dental Board Disciplinary Process

The IDFPR receives numerous complaints each year against dental professionals. Most of these complaints come from consumers, while some originate from other state agencies. Common reasons for complaints against dentists include:

  • Unethical/Unprofessional Conduct
  • Substandard Practice/Care
  • Poor Sanitary Conditions
  • Unlicensed Practice of Dentistry (or Aiding and Abetting Others to Practice Without a License)
  • Insurance Fraud
  • Misleading or False Advertising
  • Breach of Confidentiality of Patient Records
  • Sexual Harassment
  • Sexual Misconduct
  • Financial Irresponsibility
  • "Sister State" Complaints
  • Criminal Convictions

When a complaint is lodged against a dental professional, it is reviewed by the IDFPR to determine if it has merit. If so, it may be referred to an investigator. At this point, the licensee may be contacted by the investigator to provide additional written information, or with a request to be interviewed. If the investigation turns up enough evidence to imply misconduct, the IDFPR may file a complaint or schedule a Disciplinary Conference. Dentists may also face disciplinary action if they are subject to a suspension or revocation of their DEA registration following a DEA investigation of their patterns of prescribing or dispensing controlled substances.
